Are you entitled to a divorce?

You have to have been married or in a civil partnership for at least a year to issue divorce proceedings.

What are the grounds for divorce

You can rely on any one or more of the following grounds for a divorce.

  • Adultery and Intolerability  (not applicable for civil partners)
  • Unreasonable Behaviour
  • Desertion for two years
  • Two years’ separation with the Respondent’s consent
  • Five years’ separation

We can advise you about the most appropriate ground to rely upon.

The Court must be satisfied that the marriage or civil partnership has irretrievably broken down.

No-Fault Divorce

On 6th April 2022 ‘no-fault divorce’ and The Divorce, Dissolution and Separation Act 2020 came into force.

This now means that married couples will be able to seek a divorce without having to assign blame. The new law will allow for a statement of irretrievable breakdown, joint applications and for one party to start the process without assigning blame. There will also be no ability for parties to contest the divorce.

The previous requirement for blame created an unnecessary distraction for many people engaging in the divorce process. As specialist Family Solicitors we focus on reaching a resolution as quickly and as constructively as possible.

How long will the process take?

If there are no complex difficulties the process should take from 8 – 12 months.

What if my spouse doesn’t want a divorce?

As long as you can persuade the court that the marriage or civil partnership has irretrievably broken down you will still be able to obtain your divorce as long as you can show your spouse or civil partner has been served with the divorce petition.  We can help you with this.

Do I need to deal with the finances of the marriage?

You can opt to deal with the finances of the marriage at the same time as your divorce or at a later date.   We can help you decide when to deal with the finances so it is most beneficial for you.  Please see our Financial Settlement page.

Will the courts also deal with the children?

The Court will not automatically deal with whom the children live with or contact issues during the court process. If you cannot agree arrangements for your children, you can make a separate application under the Children Act 1989.  If you would like us to assist you with this please see our Children page.

How much will a divorce cost?

We offer a fixed fee divorce service for £800.00* (exc. vat) if you wish to petition for divorce.  This will include a step by step service through the whole process. Please note that there will be additional court fees of £593.00. You may qualify for Legal Aid if you have gateway evidence – please see our Legal Aid page or ask for more details.
