Divorce Financial Settlement Solicitors – London

Our Solicitors will Guide you to a Fair Divorce Financial Settlement

Reaching a fair outcome in a divorce financial settlement requires strategic advice, careful negotiation and, where necessary, strong court representation. As experienced divorce financial settlement solicitors we advise clients at every stage of financial negotiations, from early settlement discussions to contested court proceedings.

Based in North London, we act for clients across the capital and surrounding areas. We are committed to achieving cost-effective resolutions wherever possible, encouraging negotiation and lawyer-led mediation where appropriate. However, when court proceedings are necessary, we have extensive experience securing favourable financial court orders, including robust spousal maintenance orders and complex asset division outcomes.

Advice can be delivered by telephone, secure video call or face-to-face at our North London office in Wood Green. The first step to a fair financial settlement is to book a fixed fee family law consultation.

Our Approach

Financial issues are often the most challenging aspect of divorce. Whether you are concerned about protecting pre-marital wealth, securing ongoing income, or understanding typical divorce settlements, early legal advice is essential.

As specialist divorce financial settlement solicitors in London, we guide clients through negotiations involving both matrimonial assets vs non matrimonial assets. We explain how the family court approaches fairness, needs, sharing and compensation, and how these principles apply to your circumstances.

We aim to avoid unnecessary litigation wherever possible. Lawyer-led mediation can often provide a faster, less stressful and more cost-effective route to agreement. However, mediation is not suitable in every case. Where voluntary settlement cannot be achieved, or where there are safeguarding or disclosure concerns, we are fully prepared to represent you in financial remedy proceedings.

Importantly, we advise clients on the risks of proceeding with a divorce without a financial settlement. Without a properly drafted and approved Financial Order, financial claims can remain open long after the Final Order has been granted.

My experience of Tyrer Roxburgh thus far has been exceptional. I have been going through a particularly difficult time in my life, and the expert advice I have received in preparing a non-molestation application and occupation order was both helpful, reassuring and beyond excellent. I was recommended this firm by a friend, but had put in enquiries with many others. It was the initial call I received from Anastasia that really helped me firm up my decision to proceed with engaging Tyrer Roxburgh, as she was compassionate, professional, patient and helpful throughout. She has continued to be so as my case continues. I couldn't be more grateful to have engaged her services.

Don't bother with this legal firm. Just received a silly email that has no relevance to my situation. After being told by multiple qualified parties to pursue my case and my options , someone else fitting the usual profile is telling me to disagree with professional advice already provided. Already reviewed in detail by someone with 32 years legal experience. They appear to act according to bias. I will pursue my matter accordingly no matter what exaggerated and illegitimate concerns are raised. I was told by many to take action and that is exactly what I am going to do.

I was unfortunate enough to go through a divorce but fortunate enough to do this with Vas from Tyrer Roxburgh by my side. She went above and beyond to ensure that the process was carried out as painlessly as possible with the best possible outcome for myself and my children. I can honestly say that Vas was not only professional and every other word I can think of to describe incredible but she was human, she understood what I was going through, she laughed at my bad jokes, she genuinely cared, she encouraged me when it was needed as well and keeping me on a realistic path when things got a bit out of hand. I cannot praise her highly enough or thank her enough for everything she did to support me and the children through the brutal process of a difficult divorce.
Had a very good experience with this firm, working with trainee solicitor Ms Anastasia Chen has left me with satisfactory results to my long ongoing family matter, I thank her once more for all of her efforts and unwavering dedication during my case, as I see she has done the same for many others also. I am very grateful for her work on my case, as I have finally reached a good conclusion to my case thanks to this firm and Ms Anastasia, who worked diligently and also expressed a great deal of kindness to me on top of it all. Would definitely recommend this firm as well as the solicitor Anastasia Chen to anyone.

Vas, TR Partner, was recommended to me by one of her previous clients and subsequently approached to manage a protracted matrimonial matter for a close family friend, the context being a poor and prior experience with aAnother Legal Firm and Solicitor therein. With a horrendous and prior experience in mind, the first and most important qualities we found in Vas was her warmth, approachability and empathy, Vas's ability (and i would argue in the legal profession 'willingness' ) to respond to queries both formally and informally lead to a very fluid engagement and legal journey and a real sense that we existed as clients and our issues, albeit small on occasion, actually mattered. Vas managed to unpick the prior position we found ourselves in then managed, lead and explained the legal process of divorce moving forward, all of which was carried out effectively and efficiently with an awareness of our legal costs in mind. Without hesitation i would recommend Tyrer Roxburgh as a firm and Vas in particular for resolution of your divorce and matrimonial matters - you will find her client care skills, her mannerisms and her attention to detail exceptional. My sincere thanks to all at Tyrer Roxburgh for not manifesting as the legal stereotype and for just getting the job done.

Specialist High Net Worth Division

We act for clients with complex and substantial asset structures through our specialist High Net Worth Divorce division. These cases often involve business assets, trusts, cryptocurrency holdings, shares, overseas investments and multi-layered property portfolios.

Our approach combines technical legal expertise with commercial awareness. We work closely with accountants, valuers and, where necessary, a divorce forensic accountant to ensure full and accurate financial disclosure. We advise on business assets and divorce, the valuation of private companies, and strategies for protecting ongoing commercial viability while securing a fair outcome.

For clients concerned about how to protect assets from divorce, we provide realistic advice grounded in English family law principles. While the court’s focus is fairness, there are legitimate steps that can be taken to structure negotiations strategically and lawfully.

DIVORCE FINANCIAL SETTLEMENT EXPERTISE

Property Matters and Divorce

We advise on matrimonial home rights, property adjustment orders and mesher orders.

We also advise on jointly owned investments and property portfolios, including foreign assets where overseas property is involved.

Divorce and Pensions

Pensions are frequently one of the most valuable matrimonial assets. We advise on pension sharing order applications and pension offsetting strategies to ensure long-term financial fairness and retirement security, including for silver divorcees over 50.

Business Assets and Divorce

Where one or both parties own a business, specialist advice is essential. We advise on valuation methodology, liquidity considerations and structuring settlements that preserve business continuity while ensuring fair division.

Finding Hidden Assets and Freezing Orders

Full and frank disclosure is fundamental in financial proceedings. If there are concerns about hidden assets during divorce or finding hidden assets after divorce, we can take decisive action.

We advise on Form E disclosure applications, third-party disclosure and, in appropriate cases, freezing orders to prevent the dissipation of assets before settlement.

Divorce and Pensions

Financial claims do not automatically end when a divorce is finalised. We advise on financial claims post divorce where no financial order was previously made, including a financial settlement after 5 years separation, and advising on the remarriage trap, helping clients secure clarity and protection for the future.

Advice for Unmarried Couples

Financial disputes are not limited to married couples. We also advise non married couples who are separating, including disputes over property ownership, beneficial interest and TOLATA claims and financial provision for children. The legal framework differs significantly from divorce law, and specialist advice is crucial.

Asset Protection and Future Planning

As part of a holistic approach, we also advise on Wills and Lasting Powers of Attorney following separation. Divorce can significantly affect succession planning, and early review is essential.

We provide strategic guidance for clients seeking to protect assets from divorce in future relationships, ensuring that planning is aligned with current legal principles.

Fixed Fee Family Law Consultation

We offer a fixed fee family law consultation to provide clarity at the very start of the process. During this meeting, we will explain your legal position, clarify the difference between separation and divorce where relevant, outline your options and provide practical next steps tailored to your circumstances.

Advice can be delivered in the way that suits you best — by telephone, secure video call or face-to-face at our North London office in Wood Green.

Divorce and the Financial Settlement: Q&A

What is a typical financial order in divorce?2026-09-11T11:49:28+01:00

There is no standard financial order, but most settlements follow familiar patterns. One spouse might keep the family home (often with an agreement to pay the other their share) while in other cases the house is sold and the proceeds divided.

Pensions are usually split by percentage, or one partner keeps the pension and the other takes extra cash or equity to balance things out. A lump‑sum payment can help one spouse buy a new property, and spousal maintenance may be set for a limited period, tapering off as the recipient becomes financially self‑sufficient. Judges weigh needs first (particularly housing and childcare) then look at contributions and the goal of achieving a clean break where possible.

For more detailed information please visit. Typical Divorce Settlements

What is a divorce consent order?2026-09-11T11:49:26+01:00

A divorce consent order is the document that turns your private agreement into a binding judgment. Divorce financial settlement solicitors can help you draft the terms accurately accompanied by a financial statement (Form D81). A judge reviews these on paper to ensure overall fairness, then seals the order—usually without a hearing. Once sealed, non‑payment of a lump sum or refusal to transfer property can be enforced, giving both parties security.

For more detailed information please visit: What is a Consent Order?

What is Form E?2026-09-11T11:49:28+01:00

Form E is the detailed financial‑disclosure form each spouse must complete and exchange so the court—and the other party—sees a full, verified snapshot of their money. It asks for personal details, information about dependent children, valuations of property, bank balances, investments, business shares and vehicles, current pension transfer values and projected retirement income, plus a schedule of all debts, credit cards and tax liabilities.

You must also set out income from salary, dividends, rent or benefits, estimate present‑day living costs and forecast your budget and housing needs after the divorce. After forms are exchanged, either side can raise written questions if something looks unclear or undervalued. Supplying incomplete or inaccurate figures can lead to cost penalties, the order being overturned, or in serious cases contempt of court, so most people ask a solicitor to check the document before it is filed.

For more detailed information please visit: Understanding the Form E in Divorce Proceedings

Can you do a financial settlement without a solicitor?2026-09-11T11:49:26+01:00

Strictly speaking, you can come to an agreement and draft a consent order yourself, but the rules are quite technical and a small mistake can cause issues. Every figure must align with Form D81, pension wording must satisfy scheme rules, and incomplete disclosure lets an ex-spouse reopen the case. Judges reject many DIY orders for errors, leaving couples in limbo. Qualified divorce financial settlement solicitors check the numbers, anticipate issues and produce wording the court are more likely to seal first time. In short, using a family solicitor is strongly advisable if you want the agreement to stand up in court and protect your financial future.

A good place to start is a fixed fee one hour family law consultation.

Is there a time limit for applying for a financial settlement?2026-09-24T15:06:22+01:00

There is no financial settlement time limit, but leaving matters open is risky. In Wyatt v Vince the Supreme Court allowed a wife to pursue a claim more than twenty years after divorce because no order had ever dismissed her rights. The case generated years of litigation and costs. The practical limit is therefore one of evidence, cost and the judge’s discretion, not a strict deadline. Filing Form A during the divorce avoids arguments about delay and ensures both sides exchange disclosure at the same time.

For more detailed information please visit: Negotiating a divorce financial settlement and time limits.

Is it possible to make a financial settlement after divorce?2026-09-11T11:49:26+01:00

Yes. The court retains power to make financial orders even years later, unless that power is removed by a clean‑break order. Couples sometimes delay if a business sale is pending, a pension is not yet valued, or emotions are raw.

Waiting, however, brings practical problems: assets change value, documents disappear, and people forget key facts. Judges will look closely at the reason for delay and at each party’s current financial position. While the court can still impose a fair outcome, prolonged uncertainty often leads to higher costs and friction. Reaching terms sooner keeps legal fees down and gives greater certainty to both parties.

Can you get divorced without a financial settlement?2026-09-11T11:49:26+01:00

Technically, yes you can finalise the divorce without a financial settlement, but it is rarely wise. England and Wales operate on the principle that matrimonial financial claims survive the divorce unless dismissed by a court order. That means an ex‑spouse could apply (sometimes decades later) for a share of property, pensions, bonuses or even a lottery win.

Can I get legal aid for a financial settlement?2026-09-11T11:49:26+01:00

Legal aid now applies only where you can show recent domestic abuse or child‑protection concerns and pass strict income and capital checks. If you qualify, it can pay for your solicitor, court fee, mediation and expert valuations. Documentary proof (such as a non-molestation order, police report or social‑services letter) is essential, so it’s important to contact a legal aid family solicitor quickly to confirm eligibility and file the paperwork.

For more information please visit: Family Law Legal Aid Eligibility.

What role does mediation play in the financial settlement?2026-09-11T11:49:26+01:00

Mediation gives separating couples a confidential space to explore solutions without going to court. A trained family mediator remains neutral but helps identify priorities, reality‑test budgets and draft a memorandum of agreement.

Anything you decide remains “without prejudice” until you both instruct solicitors to convert it into a consent order. Attending a Mediation Information and Assessment Meeting (MIAM) is compulsory before issuing an application for a financial order unless an exemption (such as domestic abuse) applies. Many couples reach a mediated settlement in three or four sessions and only use the court for the paperwork stage, saving significant fees and stress.

For more detailed information on this topic please visit: Family Law Arbitration and Mediation

Can I remarry without a financial settlement?2026-09-11T11:49:26+01:00

You can, but remarriage without issuing Form A (financial order application) first is known as the “remarriage trap.” It blocks claims for lump sums, property adjustment and maintenance against your former spouse (pension sharing remains possible). If marriage plans are imminent, file your financial application or submit a consent order before the ceremony. Where timing is tight, a divorce financial settlement solicitor can help lodge an urgent Form A to keep your options open.

Does a new partner affect my divorce settlement?2026-09-11T11:49:28+01:00

Your relationship status can influence different parts of the court’s calculation. If you cohabit with a new partner, judges look at the practical impact: shared household bills, rent or mortgage contributions and overall living costs. Where joint finances reduce your monthly outgoings, the court may conclude you need less (or no) spousal maintenance.

That said, the new partner’s savings and property remain outside the asset pot unless there is evidence you have diverted personal wealth into their name to shield it from division. Cohabitation is treated more seriously than casual dating. Even so, the court will not assume you can rely on the new partner long‑term; it still tests whether the proposed settlement meets your needs without creating undue hardship for either side. Remarriage is different: the moment you remarry, any right to claim maintenance, lump sums or property adjustment from your former spouse (except a pension share already sought) disappears. Always finalise or at least initiate your financial application before tying the knot, otherwise you may lose valuable claims.

For more detailed information on this topic please visit: Does a new partner effect my divorce financial settlement?

Who gets the house in divorce?2026-09-11T11:49:28+01:00

Judges begin with the children’s need for stable housing, then weigh each parent’s mortgage capacity and the total asset pot. Sometimes the house is transferred to the main carer with an agreement that the other parent will receive their share of equity. In other cases a sale is postponed until a set date, giving the children continuity while both parents share any future increase in value.

Where immediate sale is unavoidable, the net proceeds are divided to ensure both households can re‑house. If neither party can afford to stay or buy elsewhere, downsizing or renting may be the only workable option. Family help with deposits, the size of any outstanding mortgage and local housing costs all feed into the judge’s assessment of what is fair.  Judges typically weigh children’s welfare, housing needs, mortgage capacity and overall fairness when deciding “who gets the house”.

For more detailed information on this topic please visit: Who gets the House in Divorce.

Is my pension considered in the divorce settlement?2026-09-24T10:23:18+01:00

Yes. Pensions in divorce can be worth as much as, or more than, the family home, so the court treats them as part of the pot to be divided. There are three main ways to deal with them. A Pension Sharing Order transfers a set percentage of one person’s pension into a brand‑new pot for the other, giving each of you your own fund. A Pension Attachment Order (sometimes called ear‑marking) keeps the pension where it is but directs that, when the member retires, an agreed slice of the lump sum or monthly income is paid to the ex‑spouse; this keeps you financially linked.

The third route is off‑setting: the pension stays untouched and the other spouse takes extra cash or equity instead, so the overall deal is still fair.

For more detailed information on this topic please visit: Pensions and Divorce.

Is future inheritance considered in the divorce financial settlement?2026-09-11T11:49:28+01:00

Potential inheritance during divorce is generally ignored because it is uncertain and depends on the choices of a third party (the testator). If an inheritance is imminent and definite—for instance, probate is underway and you are named as a principal beneficiary—the court may treat it as a resource when assessing needs.

Once inheritance is received, it enters the asset schedule, but its treatment varies: in a long marriage where family wealth was shared, it may be divided to meet both parties’ housing requirements; in a short marriage without children, a judge might ring‑fence a large proportion for the beneficiary, provided the other spouse’s reasonable needs can still be met from the remaining assets.

For more detailed information on this topic please visit: Is future inheritance considered in a divorce settlement?

What is a financial order in divorce?2026-09-24T14:46:12+01:00

A financial order is the court’s rubber‑stamp on how you agree to share finances or, if you cannot agree, the judge’s final decision on how assets and income will be split. It can include lump‑sum payments, property transfers, pension sharing and ongoing spousal maintenance, all written into a single sealed document that closes the door on future claims.

Without that seal, either former spouse could return years later to try to make a financial claim. You can apply for a financial order by consent or ask the court to impose an outcome after disclosure and negotiation. Because the order is legally enforceable, it protects both parties and gives lenders, pension providers and HMRC clear instructions.
