How Long Can Social Services Keep a Case Open?

There is no fixed time limit for how long social services can keep a case open. The length of involvement depends on the level of concern, the type of intervention, and whether the issues affecting the child’s welfare have been resolved.

How Long Different Types of Social Services Cases Last

Child in Need (CIN) Plan

Reviewed every 3 months to assess whether support is still needed.
– If the child’s situation improves, the case may be closed.
– If concerns continue, the case can remain open indefinitely or escalate to a Child Protection Plan.

Child Protection Plan (CPP)

– Social services will hold review meetings every 3 months to decide if the plan should continue.
– If risks are reduced, the case may be stepped down to a CIN Plan or closed.
– If concerns increase, social services may start care proceedings to remove the child.

Care Proceedings & Court Orders

– If social services apply to court, care proceedings should be completed within 26 weeks (6 months) unless an extension is granted.
– If a Supervision Order is made, it can last up to 1 year (extendable to 3 years).
– If a Care Order is made, social services will be involved until the child turns 18, unless the order is discharged.

When Will Social Services Close a Case?

Social services will close a case when they believe there is no longer a need for their involvement. This could happen when:

  • The child’s home environment is safe and stable.
  • Parents have engaged with support services and made positive changes.
  • The child’s needs are being met without intervention.

However, if new concerns arise, social services can reopen a case at any time.

Can I Challenge Social Services If I Think My Case Should Be Closed?

Yes, if you believe social services are keeping your case open unnecessarily, you can:

– Request a review meeting to discuss the progress of your case.
– Ask social services for a clear plan and what steps are needed to close the case.
– Seek legal advice if you believe their involvement is unfair or excessive.
